Reasons For Recall to Editor Nellene Teubner

In his letter of August 2, Bob Fairbanks raises many of the most common misconceptions about the recall of Diane Harkey. Reasons for the recall are described on the recall web site www.dianeharkerecall.com. Bad language (not ’taste’), is not a primary charge. However, while other people may have uttered offending words at the incident he refers to, reports persist that Harkey was heard and seen mouthing obscenities. Recalls are available when the public perceives an official has failed to perform according to the values or promises he/she campaigned on. Criminal acts and malfeasance are generally not behind recalls. Amongst specific issues of this recall:

  • Unethical dealings centering around the Doheny House fiasco.
  • Pressuring property owners by interfering in a civil matter between private citizens and a developer (a significant donor  
  • to Harkey’s campaigns), effectively acting as an agent to that developer.
  • Potential ethics violations for conflict of interest regarding participation in decision making on issues related to the Town Center plan.
  • Failure to live up to her commitment to represent the city by running for statewide office twice in the 2 ½ years of her first term on the council.

Meanwhile, I don’t know where the $100,000 figure came from. In fact, cost would be minimal, because the recall would be part of the primary election, not requiring a special election. No evidence or information is cited showing that the recall was proposed by ‘a small group’ of people, and no ‘author’ of the recall came in ‘dead last’ in a run for the council five years ago.

"Despite public denials from her own Assembly staff, just a few months ago, Diane Harkey disclosed under penalty of perjury an interest of up to $1,000,000 in "Point Center Financial," a company being sued by investors for fraud and under investigation for operating "Ponzi scheme," bilking investors, according to the Los Angeles Times and KNBC News. Harkey's recent mandatory financial disclosures as an elected official now prove her connection to the troubled company and may become evidence in the fraud litigation."

Diane Harkey's sad legacy in Dana Point-

  • a failed Town Center project;
  • more government spending;
  • more regulations;
  • more city union employees;
  • fewer businesses.
